Terms of Service

1. Acceptance of Terms

By accessing or using the FDhub platform ("Service"), operated by FDhub ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

These terms apply to all users, including hotel administrators, staff members, and any other individuals who access the platform.

2. Description of Service

FDhub is a cloud-based Software as a Service (SaaS) platform designed for hotel front desk management. The Service includes, but is not limited to:

• MOD (Manager on Duty) daily reports
• Staff scheduling and shift management
• Task assignment and tracking
• Internal notifications and communications
• Document management (checklists, SOPs)
• User and team management

3. Account Registration

To use the Service, you must register for an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

Each hotel organization constitutes a separate tenant with its own isolated data environment. The account administrator is responsible for managing users within their organization.

4. Subscription Plans and Billing

FDhub offers various subscription plans, including a free trial period. By subscribing to a paid plan:

• You agree to pay the applicable fees as described on our pricing page
• Subscriptions are billed on a recurring monthly basis
• Payments are processed securely through Stripe
• You may cancel your subscription at any time; access continues until the end of the current billing period
• We reserve the right to modify pricing with 30 days' advance notice

5. Free Trial

New accounts may be eligible for a free trial period of 14 days. During the trial:

• You have full access to the platform features
• No payment information is required to start a trial
• At the end of the trial, you must subscribe to a paid plan to continue using the Service
• If you do not subscribe, your account will be suspended but your data will be retained for 30 days

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to other accounts or systems
• Use the platform for purposes other than hotel front desk management
• Share your account credentials with unauthorized individuals
• Interfere with the proper functioning of the Service

7. Data Ownership

You retain full ownership of all data you enter into the Service ("Your Data"). We do not claim any intellectual property rights over Your Data. You grant us a limited license to process, store, and display Your Data solely for the purpose of providing the Service.

Upon termination of your account, you may request an export of Your Data within 30 days.

8. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. We may temporarily suspend the Service for:

• Scheduled maintenance (with advance notice when possible)
• Emergency security updates
• Circumstances beyond our reasonable control

9. Limitation of Liability

To the maximum extent permitted by law, FDhub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• Your subscription payment fails and remains unpaid
• Your account remains inactive for an extended period

You may terminate your account at any time by contacting us. Upon termination, your access to the Service will cease, and your data will be retained for 30 days before deletion.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify registered users of material changes via email or through the platform. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation or, if necessary, through binding arbitration.
